1. Acceptance of Terms

By accessing or using the IQ Jobs app (the "App"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you ("User", "you", or "your") and IQ Jobs ("we", "us", or "our"). If you do not agree with any part of these Terms, you must immediately discontinue use of the App.

2. User Accounts and Responsibilities

2.1 Account Registration

To use certain features of the App, you must create an account by providing accurate, current, and complete information during the registration process. You agree to:

• Provide truthful and accurate personal information
• Maintain and promptly update your account information to keep it accurate and complete
• Keep your account credentials confidential and secure
• Not share your account with others
• Notify us immediately of any unauthorized access or security breach

2.2 Account Responsibilities

You are solely responsible for:

• All activities that occur under your account
• Maintaining the security and confidentiality of your password
• Any actions taken through your account, whether authorized by you or not
• Ensuring your account information remains accurate and up-to-date

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms, engage in fraudulent, abusive, or illegal activities, your account has been inactive for an extended period, or we determine that your continued use poses a risk to the App or other users.

3. Use of the Platform

3.1 Permitted Use

The IQ Jobs app may only be used for lawful job-seeking and recruitment purposes in accordance with these Terms. You may use the App to:

• Search and browse job listings
• Create and maintain a professional profile
• Apply for job opportunities
• Communicate with potential employers through the App's features
• Receive notifications about relevant job opportunities

3.2 Prohibited Activities

You agree NOT to:

• Post false, misleading, or inaccurate information about yourself or others
• Impersonate any person or entity, or falsely misrepresent your affiliation with any person or entity
• Use the App for any unlawful purpose or in violation of any local, state, national, or international law
• Attempt to gain unauthorized access to the App, other users' accounts, or computer systems or networks
• Interfere with or disrupt the operation of the App or servers or networks connected to the App
• Use any automated systems (such as robots, scrapers, or spiders) to access the App without our prior written permission
• Upload, post, or transmit any content that contains viruses, malware, or other harmful code
• Collect or store personal data about other users without their explicit consent
• Use the App to spam, harass, threaten, or abuse other users
• Engage in any discriminatory practices based on race, religion, gender, age, disability, or other protected characteristics
• Post content that is defamatory, obscene, offensive, or violates intellectual property rights
• Use the App for commercial solicitation unrelated to legitimate job seeking or recruitment

4. Job Listings and Applications

4.1 Job Listings

IQ Jobs provides a platform that connects job seekers with employers and recruiters. We do not:

• Guarantee the accuracy, completeness, quality, or availability of job listings posted by third-party employers or recruiters
• Verify the identity, credentials, or legitimacy of employers or job postings
• Guarantee that you will receive responses to your applications
• Promise job placement or employment outcomes

4.2 Application Process

When you apply for jobs through the App:

• Your profile information and application materials may be shared with the employer or recruiter
• You authorize us to transmit your information to potential employers
• You represent that all information provided is accurate and truthful
• You understand that employment decisions are made solely by employers, not by IQ Jobs

4.3 Third-Party Relationships

IQ Jobs is not responsible for hiring decisions, job offers, or employment terms; communications, agreements, or disputes between users and employers; the conduct or actions of employers, recruiters, or other users; or any employment relationship that may result from using the App.

5. Intellectual Property

5.1 Ownership

All content, features, functionality, trademarks, service marks, logos, trade names, and materials available on the IQ Jobs app are owned by IQ Jobs, its affiliates, or its licensors and are protected by copyright, trademark, patent, trade secret, and other applicable intellectual property laws.

5.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the App for your personal, non-commercial job-seeking purposes.

5.3 Restrictions

You may not copy, modify, distribute, sell, or lease any part of the App; reverse engineer, decompile, or disassemble the App or attempt to derive its source code; remove, alter, or obscure any copyright, trademark, or other proprietary rights notices; create derivative works based on the App; or use the App's name, logo, or trademarks without our prior written consent.

5.4 User Content

You retain ownership of content you submit to the App (such as your resume, profile information, and application materials). By submitting content, you grant IQ Jobs a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with operating and providing the App's services.

6. Limitation of Liability

6.1 Service Provided "As Is"

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy, reliability, or completeness of content.

6.2 Limitation of Damages

To the fullest extent permitted by applicable law, IQ Jobs, its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, or use; business interruption or loss of goodwill; or damages arising from your use of or inability to use the App. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other legal theory.

6.3 Maximum Liability

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our total liability to you for any claims arising from or related to these Terms or the App shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

6.4 Third-Party Actions

IQ Jobs shall not be responsible or liable for the actions, content, information, or data of third parties, including employers, recruiters, and other users. You release us from any claims and damages arising from or related to such third parties.

7. Indemnification

You agree to indemnify, defend, and hold harmless IQ Jobs, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, partners, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations
• Content you submit, post, or transmit through the App
• Any fraudulent, misleading, or inaccurate information you provide

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our Privacy Policy and agree that we may collect, use, and share your information as described therein.

9. Changes to Terms

9.1 Right to Modify

We reserve the right to update, modify, or replace these Terms at any time at our sole discretion. Changes may be made to reflect changes in our services, comply with legal or regulatory requirements, improve clarity, or respond to security or technical considerations.

9.2 Notice of Changes

When we make material changes to these Terms, we will update the "Last Updated" date at the top of this document and may notify you through the App, via email, or through other reasonable means. For significant changes, we may require you to affirmatively accept the new Terms.

9.3 Acceptance of Changes

Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the modified Terms, you must stop using the App and may delete your account.

9.4 Checking for Updates

It is your responsibility to review these Terms periodically for changes. We recommend checking the "Last Updated" date regularly to stay informed about any updates.

10. Dispute Resolution and Governing Law

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the applicable laws, without regard to conflict of law provisions.

10.2 Dispute Resolution

In the event of any dispute, claim, or controversy arising from or relating to these Terms or the App, both parties agree to first attempt to resolve the dispute through good faith negotiation. If negotiation fails, the parties may pursue mediation or arbitration before resorting to litigation. Any legal action must be brought within one (1) year after the claim or cause of action arises.

10.3 Jurisdiction and Venue

Subject to any applicable arbitration provisions, you agree that any legal action or proceeding shall be brought in the courts of competent jurisdiction, and you consent to the personal jurisdiction of such courts.

11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published by us on the App, constitute the entire agreement between you and IQ Jobs regarding the use of the App.

11.2 Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

11.3 Waiver

No waiver by IQ Jobs of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

11.4 Assignment

You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, at any time without restriction.

11.5 Force Majeure

IQ Jobs shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

11.6 No Agency

No agency, partnership, joint venture, employer-employee, or franchiser-franchisee relationship is intended or created by these Terms.

11.7 Survival

Any provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

12. Termination

12.1 Termination by User

You may terminate your account and stop using the App at any time by deleting your account through the App settings, contacting our support team, or uninstalling the App from your device.

12.2 Termination by IQ Jobs

We reserve the right to suspend or terminate your access to the App immediately, without prior notice or liability, for any reason including breach of these Terms, fraudulent, abusive, or illegal activity, upon your request, extended inactivity, or discontinuation of the App or specific features.

12.3 Effect of Termination

Upon termination, your right to use the App will immediately cease, we may delete your account and all associated data, provisions that by their nature should survive termination will remain in effect, and you will remain liable for any obligations incurred prior to termination.

13. Age Restrictions

The App is intended for users who are at least 18 years of age or the age of majority in their jurisdiction, whichever is greater. By using the App, you represent and warrant that you meet these age requirements. If we learn that we have collected personal information from a user under the required age without appropriate consent, we will take steps to delete that information.

14. International Use

The App is controlled and operated by IQ Jobs. We make no representation that the App is appropriate or available for use in all locations. If you access the App from outside our primary service area, you do so at your own risk and are responsible for compliance with local laws.
